Navigating an unemployment claim can be intimidating, especially if you’re not certain about the rules, based on what you’ve seen online.
ATLANTA — Changes with your job could lead to feelings of uncertainty about your rights as a worker.
A post going viral online claims you’re able to apply for unemployment even if you are still employed, but if your hours were reduced.
THE QUESTION:
Can you apply for and receive unemployment benefits while you are still employed, but working fewer hours?
OUR SOURCES:
THE ANSWER:
Yes, you can apply for and possibly receive unemployment benefits for a reduction in hours, even if you are still employed.
Eligibility is determined on a case-by-case basis, depending on various factors, and the amount can change based on how much you make on your job.
WHAT WE FOUND:
According to the Georgia Department of Labor, anyone can apply for benefits anytime, but it doesn’t guarantee eligibility.
When someone files due to a reduction in hours, several factors are considered: your current employment status, the reason for the reduction in hours and the terms of your hiring agreement. For example, if you were guaranteed a certain number of hours that is no longer being met.
In addition to that, those filing claims are required to report their gross weekly earnings for each week they request benefits.
Earnings after the first $50 are deducted dollar for dollar from any potential weekly benefit amount. If reported earnings equal or exceed the benefit amount, you would not receive a payment that week.
